Appeal Process
Overview
The appeal process is available for applicants, tenants and clients of the Homeownership Programs and Public Housing Program. This process allows individuals to appeal certain decisions made by Housing NWT or Local Housing Organizations (LHO).
Who Can Appeal?

Housing NWT Rental Programs: Applicants and tenants of Public Housing or Market Housing can appeal decisions made by an LHO or District Office.

Homeownership Programs: Applicants and clients can appeal decisions made by a District Office.
Decisions That Can Be Appealed

Declined public housing applications related to eligibility

Priority given to public housing applicants on the waiting list

Calculation of rent payments for public housing tenants

Declined renewal of a fixed-term lease for a public housing unit

Declined Homeownership Program applications related to eligibility

Level of assistance approved for Homeownership Program applicants

Calculation of monthly payments under a homeownership program

How Housing NWT policies have been applied to the applicant’s circumstances
Decisions That Cannot Be Appealed

Incomplete or misleading applications

Applications declined due to budget limitations
-
Estimated assistance related to technical assessments completed by HNWT

Unit sizes as per National Occupancy Standards

Decisions that do not directly relate to an applicant’s household (e.g., allocation of a Public Housing unit to another person)

Matters involving illegal activities or criminal proceedings

Issues under the Residential Tenancies Act

General Housing NWT policies themselves, as opposed to specific instances of how these policies have been applied to an applicant’s or client’s situation.
How to Submit an Appeal
First Level of Appeal

Write Your Appeal: Prepare a written appeal (email or letter) detailing the decision you are appealing.

Send Your Appeal:

Housing NWT Rental Programs: Submit to the Local Housing Organization (LHO). In communities with no LHO, submit to the District Office.

Homeownership Programs: Submit to the District Office.

Await Decision: You will be notified in writing of the decision and further appeal options.
Second Level of Appeal

Write Your Appeal: If unsatisfied with the first level decision, prepare a written appeal (email or letter) or complete an Appeal Form.

Housing NWT Rental Programs: Submit to the District Office. In communities with no LHO, submit an Appeal Form to the Housing Appeal Committee (HAC) with a copy of the decision you are appealing.

Homeownership Programs: Submit an Appeal Form to the Housing Appeal Committee (HAC) with a copy of the decision you are appealing.

Await Decision: You will be notified in writing of the decision and further appeal options or of the date of the appeal and how to attend.
Third Level of Appeal

Complete an Appeal Form: If unsatisfied with the second level decision, complete an Appeal Form.
